Passenger rights: Commission publishes a Communication on all transport modes and moves forward on air passenger rights

The European Commission has published a Communication which provides a general overview of all passengers rights to ensure they are consistently and effectively applied across all modes of transport. In addition, the Commission has also launched a public consultation on air passenger rights which will be used to revise the current legislation in 2012. Finally it has prepared draft guidelines on the rights of disabled passengers and passengers with reduced mobility travelling by air to be discussed with Member States and stakeholders; these guidelines will then be finally adopted before the Paralympic Games take place in London in 2012.

EU Horizontal Communication on all passenger rights

The Communication adopted today provides for the first time a horizontal view of the existing EU legal framework on passenger rights in all transport modes (air, rail, waterborne and road) towards more convergence and consistency in the application of these rules.

Some fundamental questions particularly regarding the lack of uniform application and enforcement of the full set of rights in the Member States remain to be solved.

The Commission will therefore boost enforcement action through reinforced cooperation with and among national enforcement authorities and more systematic exchange of good practices, information and statistics also with stakeholders. At the same time, it will also continue to work on increasing passenger's awareness of the rights they enjoy.

Public Consultation on Air Passenger Rights

The Commission will use the contributions to the public consultation to propose a modernisation and a possible revision in 2012 of Regulation 261/2004 on the rights of air travellers:

The consultation focuses on:

  • the scope of the legislation, the rights in case of air travel disruptions (long delays and flight cancellation),
  • issues related to baggage and additional services,
  • how to reduce and share the cost of applying these rights for airlines
  • measures to improve the enforcement and the means of redress available to passengers.

After the consultation closes on 14 March 2012, the Commission will organise a public hearing in spring 2012 to present a summary of the contributions as well as give an overview of the first findings of an ongoing independent study. During this hearing stakeholders will be given the opportunity to comment during this hearing.

Guidelines on rules for disabled passengers and passengers with reduced mobility in air transport

In view of the Olympic and Paralympics Games in London in 2012, the Commission has prepared a first document aimed at ensuring a smooth and coherent application ofRegulation 1107/2006 for disabled persons and persons with reduced mobility travelling by air. This document will be discussed with stakeholders and National Enforcement Bodies in all Member States today. Their feedback will be used to finalise the paper, which will then be published in spring 2012.
